Accommodation Terms and Conditions

About the accommodation agreement

1. Scope

All accommodation contracts and related agreements to be concluded between this hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any matters not provided for herein shall be governed by laws and regulations and/or generally accepted practices.
In cases in which the Hotel has entered into a special contract with a Guest insofar as this does not violate laws, regulations and generally accepted practices, notwithstanding the provisions of the preceding paragraph, the special contract shall take precedence over the provisions of the preceding paragraph.

2. Application for Accommodation Contract

A Guest who intends to apply for an Accommodation Contract with the Hotel must provide the Hotel with the following particulars:

  • Guest name
  • Date of stay and expected arrival time
  • Accommodation fees (in principle, based on the basic accommodation fees in Appendix 1)
  • Other matters deemed necessary by the Hotel

If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph 2 of the preceding paragraph, the Hotel will regard such request as an application for a new Accommodation Contract at the time such request is made.

3.Conclusion of Accommodation Contracts, etc.

An Accommodation Contract shall be deemed to have been established when the Hotel accepts the application as stipulated in the preceding Article. However, this shall not apply when the Hotel proves that it has not accepted the application.

When an Accommodation Contract has been established in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, within the limits of the basic accommodation charges for the period of stay (if it exceeds 3 days, then 3 days), shall be paid by the date specified by the Hotel.

The application fee shall first be applied to the accommodation fee finally payable by the Guest, and in the event of the occurrence of a situation to which the provisions of Articles 6 and 18 apply, it shall be applied in the order of penalty charges and compensation, and the remainder, if any, shall be refunded at the time of payment of the accommodation fee as provided for in Article 12.

If the application fee stipulated in Paragraph 2 is not paid by the date specified by the Hotel in accordance with the provisions of the same Paragraph, the Accommodation Contract shall become void. However, this shall only apply if the Hotel so notifies the Guest when specifying the due date for payment of the application fee.

4. Special Contracts Requiring No Application Fee

Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded.

If the Hotel has not requested the payment of the application fee as stipulated in Paragraph 2 of the preceding Article and/or has not specified the due date for the payment of the application fee when accepting your application for an Accommodation Contract, it will be treated as if the Hotel has accepted a special contract as stipulated in the preceding Paragraph.

5. Refusal to conclude an accommodation contract

The Hotel may refuse to enter into an Accommodation Contract under any of the following cases:

  • When the application for accommodation does not conform to these terms and conditions.
  • When the Hotel is fully booked and no rooms are available.
  • When the person seeking accommodation is deemed to be in danger of engaging in conduct that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation.
  • When the person seeking accommodation can be clearly detected as carrying an infectious disease.
  • When the Hotel is asked to assume an unreasonable burden in relation to its accommodation.
  • When it is impossible to provide accommodation due to natural disasters, malfunctions of facilities, or other unavoidable reasons.
  • When the case falls under the provisions of Article 10 of the Kagawa Prefecture Ordinance.

6. Guest’s Right to Cancel Accommodation Contract

A Guest may cancel the Accommodation Contract by notifying the Hotel.

When the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which he/she is liable (except when the Hotel has specified a due date for the payment of the application fee as stipulated in Article 3 Paragraph 2 and requested such payment), he/she shall pay a penalty as listed in Attached Table 2.
However, in cases where the Hotel has entered into a special agreement as provided for in Article 4, Paragraph 1, this will only apply when the Hotel has notified the Guest of his/her obligation to pay penalty charges in the event that the Guest cancels the Accommodation Contract, in accordance with such special agreement.

7. Right of the Hotel to Cancel Contract

The Hotel may cancel the Accommodation Contract under any of the following circumstances:

  • When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws, public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted such conduct.
  • When the person seeking accommodation can be clearly detected as carrying an infectious disease.
  • When the Hotel is asked to assume an unreasonable burden in relation to its accommodation.
  • When it is impossible to provide accommodation due to a natural disaster or other force majeure event.
  • When the case falls under the provisions of Article 10 of the Kagawa Prefecture Ordinance.
  • When the Guest fails to observe the prohibited activities stipulated by the Hotel (limited to those necessary for fire prevention), such as smoking in bed, tampering with fire-fighting equipment, etc.

When the Hotel has cancelled the Accommodation Contract in accordance with the preceding paragraph, the Hotel shall not charge the Guest for any accommodation services etc. which he has not yet received.

13. Liability of the Hotel

The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements.
However, this does not apply when the cause is not attributable to the hotel.

If the Guest’s baggage or belongings are found left behind after his check-out, the Hotel will request instructions from the owner of the item upon request.
However, if there is no instruction from the owner or if the owner cannot be identified, items (excluding living organisms) will be stored for three months, including the day they were found, and then disposed of by the hotel.

When a Guest uses the hotel’s parking lot, regardless of whether the key to the vehicle has been deposited with the hotel or not, the hotel is merely lending the space and is not responsible for the custody of the vehicle.
However, if damage is caused intentionally or through negligence on the part of the hotel in managing the parking lot, the hotel will be liable for compensation.
